Bhoga1It was with great confidence in the Danish judicial system's responsibility and the possibility of a just decision that we awaited Judge Morten Larsen's verdict regarding the Bhoga case on the 14th December 2010.

Even greater was the disappointment at the courts incomprehensible acquittal of Kim Schmock, which was not based on reality. The judge's reasoning lacks heart and human insight bearing unmistakable signs that the decision had been taken on beforehand and that he was just casually looking for a few opinions to support his reasoning, without taking into account that these statements were actually an outright lie - disproved by a majority of witness statements.

For example, he let one untruthful statement from one person claiming that Natha had no money have a decisive influence - as opposed to 10 witnesses who unanimously confirmed that they had commitments from the Bank, within the agreed deadline.

The associations members tenacious work was sufficient to raise the necessary burden of proof in the trial where they proved Nathas real ownership of the property Møngevej 11, and Kim Schmock’s binding promise to assign without personal profit the formal ownership of Natha upon his departing from the property.

Clearly motivated by anger and revenge, Kim Schmock, Celia Clausen and Karsten Fischer constructed a story full of lies regarding the whole story of Bhoga, which Morten Larsen swallowed completely (There were very essential periods that they could not remember, but what they do remember is that they are right).

Members of the Natha Yogacenter association seek through their own way of life to promote a higher morality in society, based on warmness of heart, friendship and trust that you can rely on each other's words and promises.

Therefore the association trusted Kim Schmock and invested 1.8 million kr in the farm - and its members worked together for more than 20,000 hours to turn Bhoga into a yoga and retreat center.

Morten Larsen did not listen very attentively to the 16 witnesses who confirmed the details, including that Natha was directly involved in the purchase of the farm. And his decision shows fatal lack of the human courage that is required for a judge to make a fair decision.

What kind of justice allows that people - who through their volunteer work and trust invested so much - are now left with nothing - while one person who has done nothing special, ends up getting a farm worth millions - just because you trusted him?

Although Larsen is covered by a property deed, the courts outcome is absurd.
Natha will naturally appeal the case to a higher court of law.
